small">对于此问题，我向来乐观（虽然我相信大部分人在看完这篇文章后都会对此观点持坚决否定的态度）。我个人的观点是，只要你真的想出去并且做好了吃苦的准备，从时间上讲不存在什么来不及的因素。一切一切的准备，从理论出发，三个月已经足够了：）但对于此问题，我更多会反问，你真的来得及吗？</span></p><p><span style="font-size: small">你已经做好了有时会一个星期基本不睡觉、在学校内外各个机构跑来跑去（夸张时基本上能达到绕北京城转圈的效果）、在别人安逸的享受保研后的快乐时痛苦的查找资料接受打击的准备了吗？从实际出发，这是一个无法用时间来衡量的心理过程，也许是更为漫长的&hellip;&hellip;&hellip;&hellip;&hellip;&hellip;</span></p><p><span style="font-size: small">从9月份开始正式决定要出国，到10月考TOEFL, 再到11月邮寄出去所有的申请材料。12月初拿到第一个华盛顿大学的第一个offer，到现在权衡再三后做出去NYU的决定。可以说是我从记事时候起到现在最痛苦、最紧张的一段生活。所谓之痛苦，并非来源于忙碌的本身，而是一个又一个的打击和面对law school申请上诸多&ldquo;牛人&rdquo;所产生的震撼。</span></p><p><span style="font-size: small">请注意：申请法学院，与你站在同一竞争点的，并非各大院校的本科乃至研究生毕业生们，而是许多在君合、方达、美迈斯、各大法院、证监会甚至咨询公司工作了多年，有着丰富实践经营，手持着国际大律所知名合伙人或是学术权威们推荐信的前辈们。所以，永远不要试图靠硬拼，如果你找不到自己区别于别人的因素，你是永远不可能被注意到的。也许，可以不客气的说：在诸多申请者中，被发现是偶然，被埋没是必然！</span></p><p><span style="font-size: small">如果是有心人，并且有足够的社交能力，可以很容易与北京、上海地区的所有本科LLM，JD申请者获得直接或间接的联系。这是最重要的一个交流团体，因为我们拥有类似的背景。并且作为PKU的申请者，还会在这样的团体里建立些微自信：）</span></p><p><span style="font-size: small">如果眼界够宽，还有一些联系国外LLM和JD申请者的渠道。不过要有良好的心理素质。至少要能承受跟你交流的人会是手里握着哈佛、耶鲁半奖、全奖offer还在死等斯坦佛传说中每年只招收15个左右LLM学生，一进学校就可以有导师带的研究型项目；或者是NYU的每年10个hauser全奖项目；或者是LLM排名近几年来均高居榜首的哥伦比亚的&hellip;&hellip;你很容易发现，人类之间确实是有交流障碍的&hellip;&hellip;</span></p><p><span style="font-size: small">如果以上的准备，你都做好了。我还会建议你在回过头来考虑一下自己是否明确了自己要的是什么。不要希冀一定会有丰厚的奖学金。绝大多数情况，好校自费和烂校全奖是摆在我们面前的一个严酷的选择，那么，付出5、6万刀去换取一年的学习是否值得呢？不要认为自己目前的成绩很好就一定会被心目中的名校录取，我们所面对的竞争者可能是95界甚至更遥远的一批师兄师姐，第一名，是每一年都有的。更何况，在美国教授眼中：成绩体现能力，但并不等于能力。</span></p><p><span style="font-size: small">不要以为吃苦耐劳、虚心好学出去读书就一定适合你。个人认为，这与个人性格有很大关系，要相信金子在哪里都会发光，要相信不一定出去镀过的金就一定来得更耀眼，国内的选择也许是更好的。真的：）更不要，不要迷信前辈们的经验之谈。这些都只是参考，一定要有自己的坚定想法。沿着别人走过的路以及别人的想法，只能永远在别人的身后。因为别人的总会更适合别人自己。所以，永远不要问&ldquo;我该怎么办&rdquo;。你该怎么办只有自己才知道，即使父母、好友都不会比你自己更了解自己的。</span></p><p><span style="font-size: small">学校的选择方面，一直以来都有这样一种说法：除了前三名外（按JD排名方法，即耶鲁、斯坦佛、哈佛&mdash;&mdash;前者居高不下，后两个学校近年来的排名一直存在争议），第四名到第十三名是没有区别的，只看个人的心理定位。但是LLM的排名跟JD有所差别，yale的名次不高，斯坦佛和哥大到一直在争第一名的位置，并且连续几年都是哥大胜出。但是，LLM 的排名到底有没有参考价值还是个问题&hellip;&hellip;。</span></p><p><span style="font-size: small">另外，第四名到第十三名如果要排的话似乎也是能再分出两三个等级的&mdash;&mdash;至少按学生们和教授自己的说法如此。诸如此类乱七八糟的排名还有什么毕业生工资排名啦，bar通过率排名啦，网上很容易找到的。国外的学生似乎与我们自己的学生对法学院的定位有所区别，建议有时间多找些资料看看，结合自己的情况分析。法学院究竟如何选择，要看地理位置（特别是有意在美国从业的人）、学校排名和奖学金情况（如果有可能申请的到，牵涉了visa的问题）。但具体如何定位，更多的却是心理价值。</span></p><p><span style="font-size: small">TOP 13<br />各学校的介绍，看过这些文章会有些感触（是一个系列，自己勤劳点搜一下，基本名校都有涉及我个人在选择时，对常春藤有莫名好感，所以将其作为一个重要的考虑因素。申请的时候一共列了十个学校，分了三个层次我的top 1选择是stanford，看中的是它的小班项目。但实践证明这ms不是一个好的选择，因为law的审理委员会对大陆学生似乎不是很友好：）建议，如果不是对该校有特殊情节的话不要冒险，不然最后会弄的很郁闷&hellip;&hellip;</span></p><p><span style="font-size: small">top13里大部分学校LLM是不分专业的，例外的有HLS等。Upenn是一个两年的学位设置，分别叫LLM和LLCM，可以申请连读，也可以仅申请LLM。据Upenn的老师介绍，LLCM很值得想读学术的LLM们选择，不过录取几率不是很高，因为很多LLM和JD也在申请。与这个相似的，我感觉还有oxford的学位设置，也是一年course一年research的。</span></p><p><span style="font-size: small">对哪个学校很有兴趣，最好根据该学校专门查一些信息，在写PS和研究计划的时候也会比较有针对性。如果能找到ggjj在那边读书当然更好，直接询问他们学校的特色。学校的教授们也都很热情（前提是他/她比较有兴趣带你这个学生）</span></p><p><span style="font-size: small">保底校选哪个，主要看自己的水平和要出去读书的底线要求。比如，在国内有很好的所可以留下工作对比出去读个五、六十名的学校，我更倾向于前者。</span></p><p><span style="font-size: small">如果，要稳妥一点，我觉得可以考虑20名左右的学校作为保底，比如华盛顿开头的几所学校，声望和学术环境都不错，教授们也都很热情，不过奖学金不是很好拿。如果想拿奖出去，根据其他申请者的经验，50名左右的学校拿到全奖的可能性很大。考虑到这个因素，那一个会给钱的学校保底似乎也是个稳妥的选择。不过，觉得law school完全没必要像理科同学一样，选名次比较低的学校保底，大概因为总体竞争数量没有那么多，以致于选择范围远远大于参选者，虽然竞争强度也许更高：）</span></p><p><span style="font-size: small">另外，如果可能的话，建议跟小米们打听一下，哪些学校会很早就开始发offer,如果春节前就已经拿到保底offer，心理压力会小很多。</span></p><p><span style="font-size: small">在选择学校的同时，应该开始做申请的准备工作名校里除了NYU 和英国的学校要求T比较高外，其他的学校一般都是600左右就可以了，甚至会更低。其他的英语成绩，如果有也可以填写其辅助证明作用。</span></p><p><span style="font-size: small">研究计划我们的专业大部分学校都没有要求，有兴趣的话可以写了一并邮寄，不过有的学校明确要求不收多余的材料。有的学校可能会给申请者出一两个小题目，做命题作文，很头疼&hellip;&hellip;</span></p><p><span style="font-size: small">推荐信大部分学校是两封即可，要三封是最多的。但要注意有几所学校是要求申请者的材料有copies，包括英语成绩、推荐信、成绩单等。详见各学校的专门要求。</span></p><p><span style="font-size: small">PS：参看网上有的诸多介绍，不过要注意的是，法律本身就是语言运用的学科，如果文字上太难看应该会对申请有很大影响。另外，尽量不要试图管ggjj要PS参考，因为个人化的东西很多，如果不是很熟的话都不太会愿意给别人看：） （我试图要了几次，基本都是失败的）</span></p><p><span style="font-size: small">准备工作究竟包括什么，谁也无法给出一个确定的答案来，因为每个人都有很个人化的适合自己的方法。是发几篇论文，读些未来boss（有些学校是实行导师制度的）的书准备后期的有思想有见地的&ldquo;精神交流&rdquo;；还是做些实习积累工作经验；在或者参加各种学术活动以备被某个著名教授看重要来一封精彩的推荐信；甚至，闭门不出考LSAT、TOEFL，甚至GRE、GMAT&hellip;&hellip;</span></p><p><span style="font-size: small">上述工作，有的可以同时进行，只要你精力足够充沛。但有些是任何一样都会搭进去整个几个月的时间的。如果是大三的学生，全做到非常出色基本是不可能的。从12月到现在，一直不停的有人在问：申请时教授更看重什么。</span></p><p><span style="font-size: small">首先，每个学校的情况是不一样的。诸如西北大学，在给学生的回复里明确表示非常注重工作经验。那么作为学生来说，如果未参加过工作，实习再没有什么可圈点的地方，就很有可能被长期放到waiting list里，而法学院，waiting list跟rejection区别不大：）除此之外，要考虑个人的优点，做CV和PS是在已经存在的基础上的，而不是凭空编造的。即使经过后天的修饰也是要在先天的框架之下。比如，有的人排名很高，成绩非常漂亮。<br /></span></p><p><span style="font-size: small">如果时间充足当然可以考虑找点社会工作或实习补充一下自己的不足。但如果时间很紧迫不如就找个老师跟些研究项目，在申请时为自己的学术能力写上一笔。而对于一心扑在工作上，成绩勉强过的去的人，狠补成绩基本没什么用处（反正怎么补也补不到前十名），到不如好好在实习上下工夫。究竟什么最重要本身就没有一个可用来判断的标准，因为这种衡量不可能找到一个比较的平台。但适合自己的、个性化很强的、综合其他可以为自己增加分数（即所谓的1+1&gt;2）的经历无疑是精彩的和最有吸引力的。</span></p><p><span style="font-size: small">除了看law school在挑什么样的人时，也不能忽略要挑一个什么样的law school。要看专业排名（如果细心的话，还是可以找到或问到的）、学校的着重方向（实务还是学术）、有没有合适的教授（尤其是有心去读JSD（SJD）的人，最好再问问教授带的话录取比例有多大，读几年，这在每个学校是不一样的）。</span></p><p><span style="font-size: (Juries Doctor) 、LL.M (拉丁文法学硕士的缩写) 和S.J.D (Doctor of Judicial Science) ，在美国，本科是没有法学<span class="t_tag" onclick="tagshow(event)" href="tag.php?name=%E4%B8%93%E4%B8%9A">专业</span>的，法学院的学位主要有J.D、LL.M、J.S.D之分。除了J.D之外，美国法学院的学历教育还有一年制的硕士学位课程（Master of Laws, 简称LL.M）和二至四年的博士学位（Doctor of Judicial Science，简称JSD或SJD），通常是为国际<span class="t_tag" onclick="tagshow(event)" href="tag.php?name=%E5%AD%A6%E7%94%9F">学生</span>而开设硕士学位（LL.M）是一年制的课程，修满20至30个学分后即可毕业不用写论文，它主要是帮助学生对美国法律制度有个基本的了解。<br /><br />&nbsp; &nbsp; 　<br />&nbsp;&nbsp;&nbsp;<strong> LL.M的出路主要有三条:</strong><br /><strong><font color="#ff0000"><br /></font></strong>&nbsp;&nbsp;&nbsp; 第一，回中国作律师。这个是大多数LLM的选择。有工作经验的律师通常还是会回国，因为在国内有了一定的经济基础或家庭。而没有工作经验的LLM在美国更加找不到工作，所以还是要回来。<br /><br />&nbsp; &nbsp; 第二，在美国找到工作或一年的internship。但根据以往LLM的说法是&lsquo;it is extremely difficult to find a job offer, especially those who will support your J-1 visa&rsquo;. LLM在美国找到工作是很难的，难到什么程度？根据U Penn career office的统计，在过去6年（05年之前）LLM的班级中，成功找到工作的人仅15％，最差的一届，只有3个人找到工作。虽然各校情况存在差异性，但基本上&ldquo;找工作&rdquo;很难，尤其是对没有经验、直接去读LLM的人来说。即使在那些找到工作的人群里面，很大一部分是在国内外所有工作经验，和该外所的美国分所事先有协议，在那里工作或实习一段时间。所以，如果你是一个本科生，基本上要做最坏的打算：找不到工作，可能考完Bar就要回来。同样，intern也是很难很难的。<br />如果，要稳妥一点，我觉得可以考虑20名左右的学校作为保底，比如华盛顿开头的几所学校，声望和学术环境都不错，教授们也都很热情，不过奖学金不是很好拿。如果想拿奖出去，根据其他申请者的经验，50名左右的学校拿到全奖的可能性很大。考虑到这个因素，那一个会给钱的学校保底似乎也是个稳妥的选择。不过，觉得law />首先，每个学校的情况是不一样的。诸如西北大学，在给学生的回复里明确表示非常注重工作经验。那么作为学生来说，如果未参加过工作，实习再没有什么可圈点的地方，就很有可能被长期放到waiting list里，而法学院，waiting list跟rejection区别不大：）除此之外，要考虑个人的优点，做CV和PS是在已经存在的基础上的，而不是凭空编造的。即使经过后天的修饰也是要在先天的框架之下。比如，有的人排名很高，成绩非常漂亮。如果时间充足当然可以考虑找点社会工作或实习补充一下自己的不足。但如果时间很紧迫不如就找个老师跟些研究项目，在申请时为自己的学术能力写上一笔。而对于一心扑在工作上，成绩勉强过的去的人，狠补成绩基本没什么用处（反正怎么补也补不到前十名），<br />到不如好好在实习上下工夫。究竟什么最重要本身就没有一个可用来判断的标准，因为这种衡量不可能找到一个比较的平台。但适合自己的、个性化很强的、综合其他可以为自己增加分数（即所谓的1+1&gt;2）的经历无疑是精彩的和最有吸引力的。<br /><br />除了看law school在挑什么样的人时，也不能忽略要挑一个什么样的law school。要看专业排名（如果细心的话，还是可以找到或问到的）、学校的着重方向（实务还是学术）、有没有合适的教授（尤其是有心去读JSD（SJD）的人，最好再问问教授带的话录取比例有多大，读几年，这在每个学校是不一样的）。总之，在这种时候以细节定命运，下了功夫和随便找个地方投投就好的人即使都被录取，今后的学习也一定会有差距的&mdash;&mdash;我申请时有的地方关注的很不到位，幸好最后拿到offer的几个学校以及项目都是我开始就比较有兴趣的，不然去一个不了解的学校不了解的专业想起来都后怕。有条件的话，直接找在该校读书的师兄师姐做介绍，会有很大收获：）<br After knowing the whole case, I visited my teacher, an Arbitration Law professor, and listened to her opinions. Realizing the counterpart didn&rsquo;t completely implement their contract duty, I gave reasons as follows: First, the counterpart company didn&rsquo;t mention bearing issue, which caused that the delivered machines couldn&rsquo;t be put into the plant because of the disqualification of workshop. Thus overhaul was necessary, which delayed production and resulted loss. Based on these reasons, the counterpart didn&rsquo;t completely carry out its duty, so our party did not pay the balance on time. During this time, I found out the evidence and pictures that attested counterpart did not give reasonable suggestion and service, and made a statement in the court. Finally, the arbitration turned out that counterpart compensated our loss, in which the arbiters invoked the reasons that I stated. They had a panel made up of 3 lawyers and 5 company representatives as agents while we just had 3 persons&mdash;two lawyers and me. Under such condition, I was able to cooperate with them and clearly stated my opinions without any nervousness, which got their respect. This matter greatly inspired my enthusiasm on study. </span></span></div><div><span style="font-size: medium"><span style="font-family: Times New Roman">&nbsp;</span></span></div><div><span style="font-size: medium"><span style="font-family: Times New Roman">In addition, I took part in the contact draft in several companies. In the process, when I met a lot of problems, I often turned to my teachers for help, which made good impression on them. As I cherished each practice, I studied my specialty and English hard. With effective study method and diligence, I did well both in English and law, which helped me a lot to get scholarship every year. On the other hand, my practice inspired me to study. In practice, I exercised my legal knowledge. I also realize the big gap between theory and its application&mdash;sometimes I have master the rules but I didn&rsquo;t know how to use it in actual case. However, in China, most of lawyers come from theory study and those who can perform well in practice are insufficient. Moreover, after the China&rsquo;s entrance to WTO, there are a lot of problems with Chinese law. I think, my internship experience is not enough. In practice, I could combine substantive law with procedural law to analyze case, but I still feel my theoretical foundation is not solid enough. What&rsquo;s more, comparably speaking, the chances that I have to initiatively study and practice are not a lot.
